TERMS AND CONDITIONS 

At The Pearl Islands Charter Company, we are 100% focused on you enjoying your trip in a safe manner. The following terms and conditions will help us achieve that goal.

General Rules:

Please arrive 20 minutes prior to the departure time of your trip

Please wear enclosed footwear for safety reasons, no black soles

The Captain is in command at all times; all passengers must comply with captain and crew instructions at all times.

$5.00 port fee per passenger may apply and must be paid at the Marina, at the convenience of your party, this fee could be paid at the port or in advance.

We suggest you bring a towel, sun glasses, hat, light clothing, sunscreen and rain gear.

Number of Passengers:

The maximum number of passengers is determined y the register capacity of the vessel and will not be exceded in any circunstances. Please reffer to the fleet section for information on each particular vessel.

The Vessel:

As a general rule, The Pear Island Charter Co will try, in the best of its ability,  to operate the reserved charter in the selected boat; however, due to nature of our operations, any boat can become non operational due to an unforeseen malfunction. In that case, The Pearl Island Charter Co. will replace the selected boat with one of similar capabilities in terms of size and capacity. 

Bookings and Payments:

A 50% deposit is required to reserve the date. 100% of the charter fee must be paid 3 days before the departure date. The total amount of price of the charter must be paid before departure.

No refunds apply if the charter has to be canceled due to sea sickness or by the request of the party

You may request a full refund of deposit or transfer your deposit to an alternative date if your trip has been canceled by The Pearl Island Charter Company.

It is also up to the Captain’s discretion to cancel the trip at any given moment if the safety of the passengers or the boat is at risk.

In the event the trip is canceled at any time by The Pearl Island Charter Company, we will not be held liable for any travel costs, meals, accommodations or any other costs the customer may have incurred.

Weather:

All charters are subject to suitable weather conditions (the decision is made at the discretion of the Captain) and we reserve the right to cancel any trip due to bad weather (even at short notice).

In an instance where the weather may turn unexpectedly it is at the discretion of the Captain as to whether any, a full, or part refund is given.

Safety:

A safety brief is given on board before departure. We have the right to ask any customer to wear a life jacket at any time. All children under 16 need to be accompanied by an adult (and they must wear a life jacket at all times). Those who are unable to swim are asked to wear a life jacket at all times.

All passengers acknowledge that they are aware of the risks involved on a deep-sea fishing trip, Beach or Island hopping tour. Each passenger voluntarily participates in the tour and assumes the responsibilities and risks resulting from their participation, including all risk of property damage and injury. All signing passengers understand that each one is solely responsible for any medical costs that may directly or indirectly result from their participation in the tour. Furthermore, each one acknowledges that each person is solely responsible for any action that they participate in associated with the Tour or around this Tour, regardless if occurring before, during or after the period of the tour.

Customer Behavior:

It is required that all customers behave in a safe and respectful manner to all staff, other customers and our property.

If we find that there has been loss or damage to our equipment or vessel due to negligence or unruly behavior then the customer will be liable for replacement or repair of the item. The Captain reserves the right to cancel a trip and payment forfeited if unruly or unsafe behavior is displayed.

Alcohol:

Alcohol is allowed onboard the vessel; however, the responsible consumption of alcohol is to be adhered to.

The Captain reserves the right to: refuse alcohol onboard if he deems it to be unsafe, refuses a passenger onboard the vessel if they are under the influence of alcohol and can cancel the trip with no refund.

No Illegal substances are permitted on board; violating this rule will result in the cancelation of the trip, and the event will be reported to the proper authorities.
